Under 8 U.S.C. 1226(a), the Secretary of Homeland Security generally has the discretion to arrest and hold a deportable alien pending a removal decision or to release the alien on bond or parole. Section 1226(c), enacted out of “concer[n] that deportable criminal aliens who are not detained continue to engage in crime and fail to appear,” sets out four categories of aliens who are inadmissible or deportable for bearing links to terrorism or for committing specified crimes; paragraph (1) directs the Secretary to arrest any such alien “when the alien is released” from jail, and paragraph (2) forbids the Secretary to release any “alien described in paragraph (1)” pending a removal determination. Aliens detained under 1226(c)(2), alleged that because they were not immediately detained by immigration officials after their release from criminal custody, they are not aliens “described in paragraph (1),” even though they fall into at least one of the four categories. The Supreme Court reversed the Ninth Circuit, holding that the statute’s text does not support the argument that because the aliens were not arrested immediately after their release, they are not “described in” 1226(c)(1). Congress’s use of the definite article in “when the alien is released” indicates that the scope of the word “alien” “has been previously specified in context,” so the class of people to whom “the alien” refers must be fixed by the predicate offenses identified in subparagraphs (A)–(D). Paragraph (c)(2) does not limit mandatory detention to those arrested “pursuant to” or “under authority created by” (c)(1), but to anyone simply “described in” (c)(1). View "Nielsen v. Fourth Estate, a news organization that licensed works to Wall-Street.com, a news website. sued Wall-Street for copyright infringement of articles that Wall-Street failed to remove from its website after canceling the license agreement. Fourth Estate had applied to register the articles with the Copyright Office, but the Register had not acted on those applications. No civil infringement action “shall be instituted until . . . registration of the copyright claim has been made,” 17 U.S.C. 411(a). The Eleventh Circuit and a unanimous Supreme Court affirmed the dismissal of the suit. Registration occurs, and a copyright claimant may commence an infringement suit, upon registration; a copyright owner can then recover for infringement that occurred both before and after registration. In limited circumstances, copyright owners may file suit before undertaking registration. For example, an owner who is preparing to distribute a work that is vulnerable to predistribution infringement—e.g., a movie or musical composition—may apply for preregistration; an owner may also sue for infringement of a live broadcast before registration. The Court rejected Fourth Estate’s “application approach” argument that registration occurs when a copyright owner submits a proper application. In 1976 revisions to the Copyright Act, Congress both reaffirmed that registration must precede an infringement suit. The Act safeguards copyright owners by vesting them with exclusive rights upon creation of their works and prohibiting infringement from that point forward. To recover for such infringement, copyright owners must apply for registration and await the Register’s decision. A jury awarded Oracle damages after finding that Rimini had infringed Oracle copyrights. The court awarded Oracle fees and costs, including $12.8 million for litigation expenses such as expert witnesses, e-discovery, and jury consulting. The Ninth Circuit affirmed, acknowledging that the award covered expenses not included within the six categories of costs identified in 28 U.S.C. 1821 and 1920, and citing the Copyright Act, which gives district courts discretion to award “full costs” to a party in copyright litigation, 17 U.S.C. 505. A unanimous Supreme Court reversed in part. The term “full costs” in the Copyright Act means costs specified in the general costs statute (sections 1821 and 1920), which defines what the term “costs” encompasses in subject-specific federal statutes such as section 505. Courts may not award litigation expenses that are not specified in sections 1821 and 1920 absent explicit authority. The Copyright Act does not explicitly authorize the award of litigation expenses beyond the six categories; the six categories do not authorize an award for expenses such as expert witness fees, e-discovery expenses, and jury consultant fees. Oracle has not shown that the phrase “full costs” had an established legal meaning that covered more than the full amount of the costs listed in the applicable costs schedule. Loos sued BNSF under the Federal Employers’ Liability Act for injuries he received while working at BNSF’s railyard. A jury awarded him $126,212.78, ascribing $30,000 to lost wages. BNSF asserted that the lost wages constituted “compensation” taxable under the Railroad Retirement Tax Act (RRTA) and asked to withhold $3,765 of the $30,000. The district court and the Eighth Circuit rejected the requested offset. The Supreme Court reversed. A railroad’s payment to an employee for work time lost due to an on-the-job injury is taxable “compensation” under the RRTA. RRTA refers to the railroad’s contribution as an “excise” tax, 26 U. S. C. 3221, and the employee’s share as an “income” tax, section 3201. Taxes under the RRTA and benefits under the Railroad Retirement Act, 45 U.S.C. 231, are measured by the employee’s “compensation,” which both statutes define as “any form of money remuneration paid to an individual for services rendered as an employee.” The Court noted similar results under the Federal Insurance Contributions Act and the Social Security Act. In “Ford” the Supreme Court held that the Eighth Amendment’s ban on cruel and unusual punishments precludes executing a prisoner who has “lost his sanity” after sentencing; in “Panetti,” the Court prohibited execution of a prisoner whose “mental state is so distorted by a mental illness” that he lacks a “rational understanding” of “the State’s rationale for [his] execution.” Madison was convicted of murder and sentenced to death. He subsequently suffered several strokes and was diagnosed with vascular dementia. Madison sought a stay of execution, stressing that he could not recollect committing the crime. Alabama rejected his claim. The Supreme Court summarily reversed the Eleventh Circuit’s grant of habeas relief, holding that neither Panetti nor Ford clearly established that a prisoner is incompetent to be executed simply because of failure to remember his crime but otherwise expressed no view on Madison’s competency. Alabama set an execution date; a state court again found Madison competent.The Supreme Court vacated. Under Ford and Panetti, execution may be permissible if the prisoner cannot remember committing his crime. Memory loss may, however, factor into the Panetti analysis to determine whether that loss interacts with other mental shortfalls to deprive a person of the capacity to comprehend why the state is exacting death as a punishment. The Eighth Amendment may prohibit executing a prisoner who suffers from dementia or another disorder rather than psychotic delusions. The Panetti standard focuses on whether a mental disorder has had a particular effect; not on establishing any precise cause. In evaluating competency, a judge must look beyond any given diagnosis to a downstream consequence. The Court remanded for renewed consideration of Madison’s competency by evaluation of whether he can reach a rational understanding of why the state wants to execute him. View "Madison v. Garza signed plea agreements arising from state criminal charges, each containing a waiver of the right to appeal. Shortly after sentencing, Garza told his attorney that he wished to appeal. Counsel declined. After the time to preserve an appeal lapsed, Garza sought state postconviction relief, alleging ineffective assistance of counsel. Idaho courts rejected his claim, reasoning that the “Flores-Ortega” presumption of prejudice when trial counsel fails to file an appeal as instructed does not apply when the defendant has agreed to an appeal waiver.The Supreme Court reversed. Flores-Ortega’s presumption applies regardless of an appeal waiver. Under "Strickland," a defendant who claims ineffective assistance must prove that counsel’s representation fell below an objective standard of reasonableness and that such deficiency was prejudicial. Prejudice is presumed in certain contexts, including when counsel’s deficient performance deprives a defendant of an appeal that he otherwise would have taken. No appeal waiver serves as an absolute bar to all appellate claims; a plea agreement is essentially a contract and does not bar claims outside its scope. A waived claim may proceed if the prosecution forfeits or waives the waiver or if the government breaches the agreement. Defendants retain the right to challenge whether the waiver was knowing and voluntary. Given the possibility that a defendant will raise claims beyond the waiver’s scope, simply filing a notice of appeal does not breach a plea agreement. Garza retained a right to appeal at least some issues and the presumption of prejudice does not bend because a particular defendant may have had poor prospects. Filing a notice of appeal is “a purely ministerial task that imposes no great burden on counsel” and the accused has ultimate authority to decide whether to appeal. View "Garza v. The 1945 International Organizations Immunities Act (IOIA) grants international organizations the “same immunity from suit . . . as is enjoyed by foreign governments,” 22 U.S.C. 288a(b). At that time, foreign governments were entitled to virtually absolute immunity as a matter of international comity. In 1952, the State Department adopted a more restrictive theory, codified in the Foreign Sovereign Immunities Act (FSIA), 28 U.S.C. 1602, which gives foreign sovereign governments presumptive immunity from suit, subject to exceptions, including an exception for actions based on commercial activity with a sufficient nexus with the U.S. IFC, an IOIA international organization, borrowed from Coastal (based in India) to finance the construction of a coal-fired power plant in Gujarat. Petitioners sued IFC, claiming that pollution from the plant harmed the surrounding air, land, and water. The Third Circuit affirmed a holding that the IFC was immune from suit under the IOIA.The Supreme Court reversed. The IOIA affords international organizations the same immunity from suit that foreign governments enjoy today under the FSIA. The “same as” formulation makes international organization immunity and foreign sovereign immunity continuously equivalent. The Court noted other statutes that use similar language to place groups on equal footing. IOIA’s reference to the immunity enjoyed by foreign governments is to an external body of potentially evolving law. The fact that the President can modify otherwise applicable immunity rules is compatible with those rules changing over time in light of developments in the law governing foreign sovereign immunity. The Court noted the State Department’s position that immunity rules of IOIA and FSIA were linked following FSIA’s enactment and that an international organization’s charter can always specify a different level of immunity. Lambert filed a class action, alleging that Nutraceutical’s marketing of a dietary supplement violated California consumer-protection law. On February 20, 2015, the district court decertified the class. Under Federal Rule of Civil Procedure 23(f), Lambert had 14 days to ask for permission to appeal the order. Instead, he moved for reconsideration more than 14 days later, on March 12. The district court denied the motion on June 24. Fourteen days later, Lambert petitioned the Ninth Circuit for permission to appeal the decertification order. The Ninth Circuit held that Rule 23(f)’s deadline should be tolled because Lambert had “acted diligently” and reversed the decertification order. A unanimous Supreme Court reversed. Rule 23(f), “a nonjurisdictional claim-processing rule,” is not subject to equitable tolling. Whether a rule precludes equitable tolling turns not on its jurisdictional character but on whether its text leaves room for such flexibility. Rule 26(b), which generally authorizes extensions of time, states that a court of appeals “may not extend the time to file . . . a petition for permission to appeal.” The Rules express a clear intent to compel rigorous enforcement of Rule 23(f)’s deadline, even where good cause for equitable tolling might otherwise exist. A Ninth Circuit judge, the Honorable Stephen Reinhardt, died on March 29, 2018. The court listed Judge Reinhardt as the author of an en banc decision issued on April 9, 2018. Counting his vote made Judge Reinhardt’s opinion a majority opinion that constitutes a precedent that all future Ninth Circuit panels must follow. Without Judge Reinhardt’s vote, the opinion would have been approved by only five of the 10 members of the en banc panel who were still living when the decision was filed; those five concurred in the judgment for different reasons. The Ninth Circuit indicated that the majority opinion and all concurrences were final, and voting was completed before his death. The Supreme Court vacated, noting that a judge generally may change his position up to the moment when a decision is released. When the Ninth Circuit issued its opinion in this case, Judge Reinhardt was neither an active judge nor a senior judge; by statute, 28 U.S.C. 46, he was without power to participate in the en banc court’s decision at the time it was rendered. The Ninth Circuit “effectively allowed a deceased judge to exercise the judicial power of the United States after his death. After Dawson retired from the U.S. Marshals, his home state, West Virginia, taxed his federal pension benefits as it does all former federal employees. The pension benefits of certain former state and local law enforcement employees, however, are exempt from state taxation, W. Va. Code 11–21–12(c)(6). Dawson alleged that the state statute violates the intergovernmental tax immunity doctrine, 4 U.S.C. 111, under which the United States consents to state taxation of the pay or compensation of federal employees, only if the state tax does not discriminate on the basis of the source of the pay or compensation. The West Virginia Supreme Court of Appeals rejected Dawson’s argument.A unanimous U.S. Supreme Court reversed. A state violates section 111 when it treats retired state employees more favorably than retired federal employees and no significant differences between the two classes justify the differential treatment. West Virginia expressly affords state law enforcement retirees a tax benefit that federal retirees cannot receive. The state’s interest in adopting the discriminatory tax is irrelevant. The Court noted that the West Virginia statute does not draw lines involving job responsibilities and that the state courts agreed that there are no “significant differences” between Dawson’s former job responsibilities and those of the tax-exempt state law enforcement retirees.
